Blood Tests

A blood alcohol test is a test administered by law enforcement to determine an individual’s blood alcohol concentration (BAC).  A person’s BAC indicates the percentage of alcohol in his/her bloodstream.  In order to determine a person’s BAC, law enforcement ask him/her to take a breath, blood, or urine tests. 

When law enforcement has reason to believe that a person is driving under the influence, they will ask the person to submit to a breath test.  If the person takes a breath test and the results indicate a BAC of 0.08% or higher, he/she will be placed under arrest for driving under the influence.  In the state of California, it is illegal to operate a motor vehicle with a BAC of 0.08% or higher.   

Once a person is placed under arrest for DUI, he/she will be brought to the police station.  After being booked at the station, the person will be asked to consent to another blood alcohol test.  The second test may be administered as a breath, blood, or urine test.  Additionally, if the individual refused to submit to a breath test before the arrest, law enforcement will ask that he/she take a blood alcohol test while at the police station.
