Breath Alcohol Tests

A blood alcohol test is a test administered by law enforcement to determine an individual’s blood alcohol concentration (BAC).  A person’s BAC indicates the percentage of alcohol in his/her bloodstream.  In order to determine a person’s BAC, law enforcement ask him/her to take a breath, blood, or urine tests. 

When law enforcement has reason to believe that a person is driving under the influence, they will ask the person to submit to a breath test.  If the person takes the breath test and the test results indicate a BAC of 0.08% or higher, he/she will be placed under arrest for driving under the influence.  In the state of California, it is illegal to operate a motor vehicle with a BAC of 0.08% or higher.   

Many people do not know that the breath test is voluntary and that they have the right to refuse to submit to testing.  However, if a person refuses to submit to a breath test, law enforcement will automatically serve him/her with a Notice of Suspension.  Additionally, a person will receive a notice of suspension if he/she consents to a breath test and the result is 0.08% or higher
