DUI Laws
California law clearly states that it is illegal for a person to operate a motor vehicle while under the influence of drugs and/or alcohol. California law also states that it is illegal for a person to operate a motor vehicle with a blood alcohol concentration of 0.08% or higher. Any person who operates a motor vehicle while impaired by drugs and/or alcohol or operates a motor vehicle with a blood alcohol concentration of 0.08% or higher may be charged with driving under the influence (DUI) or driving while intoxicated (DWI). Even if a person does not have a blood alcohol concentration of 0.08% or higher, he/she can be charged with DUI if law enforcement has reason to believe he/she is operating a motor vehicle while impaired.
The DUI laws described above are codified in California Vehicle Code section 23152, subsections (a) and (b):
- 23152(a) It is a misdemeanor to drive under the influence of alcohol and/or drugs.
- 23152(b) It is a misdemeanor to drive with .08% or more of alcohol in your blood.
